The Court granted final approval of the settlement on October 5, 2006.,
Under the Settlement, the Settlement Administrator will calculate the portion, if any, of the Settlement you are entitled to receive. You do not need to file a claim form.
The Court held a Settlement Fairness Hearing on June 22, 2006. in the United States District Court for the Southern District of Ohio. The purpose of this hearing was to decide whether the settlement is fair, reasonable, and adequate, to consider the proposed plan of allocating settlement funds to eligible class members, and take into consideration any written objections filed with the Court.
At the conclusion of the Fairness Hearing, the Court issued an order approving the Settlement, certifying the Settlement Class, and awarding attorneys' fees and expenses.

The Settlement Administrator, Analytics, Inc., determined which current and former Plan participants are eligible for this distribution in accordance with the plan of allocation, as described in the ERISA Settlement. Based on the Settlement Administrator's determinations and calculations, if you were eligible to receive a payment, your share will be deposited to your Plan account as soon as administratively possible.
